Coolina $1000 Giveaway Official Rules

BY PARTICIPATING IN THIS SWEEPSTAKES, YOU AGREE TO BE BOUND BY THESE OFFICIAL RULES.

ELIGIBILITY: OPEN ONLY TO RESIDENTS OF THE UNITED STATES WHO ARE 18 YEARS OF AGE OR OLDER. VOID WHERE PROHIBITED. The Coolina $1000 Giveaway (the “Sweepstakes”) is open only to legal residents of the United States who are at least 18 years of age as of the date of entry. Owners, officers, directors, and employees of Sponsor are not eligible to participate in the Sweepstakes. The Sweepstakes is subject to all applicable federal, state, and local laws and regulations.

HOW TO ENTER: This Sweepstakes begins 7/17, at 8:00 am PDT and ends 7/26, at 5:00 pm PDT (“one week”). Sponsor’s computer clock is the official timekeeping device of the Sweepstakes. You can enter this Sweepstakes in one of the following methods:

1. Sign Up: Create an account or sign in.
2. Make a Purchase: Each purchase you make during the Entry Period increases your chance to win!

There is no limit to the number of entries per person during the Entry Period. Each purchase counts as a separate entry.

SELECTION OF WINNER; NOTIFICATION: One (1) winner (“Winner”) shall be randomly selected on  7/26, at 5:00 pm PDT], from the total eligible entries. Odds of winning depend on the total number of entries. The potential Winner will be notified on or about  7/26, at 5:00 pm PDT, by email to the address provided to Sponsor in the Entry. Neither Sponsor nor their respective affiliates, officers, directors, employees, or agents shall have liability for the potential Winner’s failure to receive an email notice of winning, regardless of the reason. In the event of any of the following, the Prize may be forfeited and an alternate potential Winner may be selected at random from the remaining eligible entries:

1. The winning entry is discovered to be invalid for any reason whatsoever.
2. A selected potential Winner either fails to comply with these Official Rules prior to delivery of the Prize or refuses the Prize.

Upon contacting a potential Winner and determining that all eligibility requirements for the Sweepstakes have been met, including without limitation the execution of an affidavit of eligibility and release (except where prohibited by law) and completion of such other documents as Sponsor may reasonably require (“Eligibility and Release”), such individual will be declared the “Official Winner” of the Sweepstakes. If any potential Winner fails or refuses to sign and return the Eligibility and Release within five (5) days of Prize notification (or such shorter time as exigencies may require), the Winner may be disqualified and an alternate Winner may be selected. The Official Winner may also be required to execute a further right of publicity release to use the Winner’s name and/or image, including, but not limited to, for advertising and promotional purposes, without further compensation.

The receipt of the Prize by the Official Winner is conditioned upon compliance with any and all federal and state laws and regulations. ANY VIOLATION OF THESE OFFICIAL RULES BY WINNER (AS DETERMINED BY SPONSOR IN ITS SOLE DISCRETION) WILL RESULT IN WINNER’S DISQUALIFICATION AND ALL PRIVILEGES AS WINNER, INCLUDING THE AWARD OF THE PRIZE, WILL BE IMMEDIATELY TERMINATED.

PRIZES: One (1) prize (“Prize”): one (1) $1000 Coolina Gift Card. All taxes on the Prize will be the sole responsibility of the Official Winner. No substitution or transfer of the Prize is permitted, and the Prize cannot be redeemed for cash. No Prize substitution is allowed except by Sponsor, who may award a prize of equal or greater value.

APPLICATION OF RULES: By entering the Sweepstakes, you warrant that you have read and agree to abide and be bound by these Official Rules and you warrant that you are not prohibited from participating in the Sweepstakes. You agree that Sponsor retains full authority, in its sole discretion, to interpret and administer these Official Rules and further agree to be bound by all decisions and interpretations made in good faith by Sponsor. Sponsor shall have the absolute right to determine, without notice to the person attempting to enter, if an Entry is in compliance with these Official Rules. If there is a dispute over the identity of an entrant, the Entry will be deemed submitted by the individual associated with the email address provided to Sponsor with the entry.

IRREGULARITIES; FORCE MAJEURE: Sponsor, in its sole discretion, reserves the right to cancel, terminate, modify, or suspend the Sweepstakes if, for any reason, the Sweepstakes is not capable of running as planned due to any of the following that affects the administration, security, fairness, or integrity of the Sweepstakes: (i) technical failures, tampering, unauthorized intervention, or fraud or (ii) any other causes beyond Sponsor’s control, including but not limited to fire, flood, natural or man-made epidemic of health, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared) or any federal, state, or local government law, order, or regulation, public health crisis, order of any court or jurisdiction (any of which is an “Irregularity”). In the case of an Irregularity, Sponsor may select the potential Winner from all eligible entries prior to the Irregularity (if appropriate). Inclusion in such drawing shall be each entrant’s sole and exclusive remedy under such circumstances. Sponsor reserves the right in its sole discretion to disqualify any entrant who tampers or attempts to tamper with the entry process or the operation of the Sweepstakes or any entrant who violates these Official Rules. Any attempt by any entrant to deliberately damage any website or undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil laws. Should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law.

RELEASE; LIMITATIONS ON LIABILITY: By participating in this Sweepstakes, you release and hold harmless Sponsor, their respective affiliates, and the foregoing parties’ directors, officers, employees, and agents of each (all collectively, “Releasees”) from any and all liability for claims, injuries, losses, damage, or harm of any kind (“Harm”) arising from or in connection with the Sweepstakes or the Prize, including but not limited to any personal injury, death, loss, or damage of any kind or any other causes of action or claims related to or arising out of (i) an entrant’s participation in this Sweepstakes, (ii) acceptance of the Prize, (iii) the Prize, including without limitation use thereof, and/or (iv) an entrant’s use of any Coolina product.

Releasees are not responsible for and have no liability for Harm caused by any of the following: (i) incorrect or inaccurate Entry information, whether caused by any of the equipment or software associated with or utilized in the Sweepstakes, or by any technical or human error; (ii) an entrant’s difficulty registering on Sponsor’s website; (iii) technical or mechanical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software; (iv) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (v) unauthorized human intervention in any part of the Entry process; (vi) electronic or human error which may occur in the administration of the Sweepstakes; (vii) any error, statement, or announcement that may give an erroneous indicator the Prize has been won; (viii) notice to a selected potential winner that is returned undeliverable to Sponsor; (ix) the failure of a potential Winner to timely claim the Prize; and (x) any Irregularity. By participating in this Sweepstakes, you waive any right to claim ambiguity in these Official Rules. Should the Sweepstakes be terminated prior to the end of the Entry Period, notice will be posted at [URL].

DISCLAIMER OF WARRANTIES: SPONSOR MAKES NO REPRESENTATIONS OR WARRANTIES, EXPRESS OR IMPLIED, ORAL OR WRITTEN, CONCERNING THIS SWEEPSTAKES OR THE PRIZE. SPONSOR EXPRESSLY DISCLAIMS ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. ANY IMPLIED WARRANTIES THAT MAY BE IMPOSED BY APPLICABLE LAW ARE LIMITED IN ALL RESPECTS TO THE DURATION OF THE SWEEPSTAKES. IN NO EVENT WILL THE RELEASEES BE LIABLE FOR ANY DAMAGES WHATSOEVER, INCLUDING WITHOUT LIMITATION, DIRECT OR INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. GOVERNING LAW: Florida State governs the operation of this Sweepstakes, these Official Rules, and the disclaimers made herein, regardless of another state’s choice of law principles. By entering these Sweepstakes, you agree to exclusive personal jurisdiction in the appropriate state or federal court residing in Florida State. All federal, state, and local laws and regulations apply.
